trademark law. Under our business operation, we
provide a specific scope of services which is set
forth in writing after the initial consultation with
you. These services, and the applicable attorney fee
charges and costs (government filing fees, etc.) are
not undertaken until you have requested that we
proceed. The Terms and Conditions published on this
Website govern the extent and expectations of
our relationship.
Paulson Patent and Trademark
Legal Services, LLC., is owned by Robert E. Paulson,
Esq., a 1964 graduate of the Georgetown University
Law School, where he was a member of the editorial
staff of the Georgetown Law
Journal. Paulson holds a B.S. degree in Nuclear
Engineering from Kansas
State University. He recently
published his memoir, Not In Kansas Anymore:
A Memoir of the Farm, New York City and Life With
ALS (2009).
Mr. Paulson is a member of the Bar of the State of
New York and
is licensed to practice (Reg.
# 21046) before the United States Patent and
Trademark Office ("USPTO"). He also has been
admitted to the United States Supreme Court, the
Federal Circuit Court of Appeals, and several
federal district courts throughout the country.
Mr. Paulson has specialized in
the practice of intellectual property law for 40+
years, at the U.S. Atomic Energy Commission and as a
member of the New York law firm of Morgan & Finnegan
from 1964-2004. He is experienced
in all phases of patent and
trademark practice, including preparation of
patentable novelty opinions; patent validity and
infringement opinions; patent and trademark license
agreements; preparation and filing of patent and
trade-
mark applications in the USPTO
and solicitation of same before the Office Examiners. Paulson's practice involved all phases of
patent and trademark infringement litigation,
including the Complaint ( or Answer), document
discovery, written interrogatories, oral
depositions and pre-trial discovery motions,
followed by trial and post-trial briefing and
appellate briefs before the Federal Circuit Court of
Appeals.
Representative of the clients
Mr. Paulson represented in his law practice at the
Morgan Finnegan firm are Osteonics Corporation,
Stryker Corporation, the Brown and Williamson and
British American Tobacco Companies, Procter & Gamble
Company, Endo Pharmaceuticals, Inc., Sanford Redmond
Company, Slater Electric, Inc. and U Control
Packaging, LLC. In particular, Mr. Paulson was a
principal attorney representing the Osteonics and
Stryker companies in two highly successful
infringement litigations involving prosthetic hip
implants. The damages awarded to the clients, in
the late 1990's, were among the highest ever at that
time --
approaching $100 Million.
Paulson Patent and Trademark Legal Services is a
virtual law office,
which means that all
communications with you (and any attached documents)
are carried out online on a secure,
password-protected website. As such, our
correspondence is maintained strictly confidential.
You ask for legal services as a result of an initial
free consultation and we respond with a price quote
based on specific legal services we will provide If
you agree to the proposed services and the quoted
attorney fee charges, and to the Terms and
Conditions stated herein, we will ask for an
advance partial payment and, upon receipt of same,
we will proceed to perform the services you have
requested.
If we are unable to perform
all of the services you request, we will suggest
another attorney or law firm who may be able to meet
your full legal needs or, alternatively, refer you
to the New York State roster of attorneys. In this
eventuality, you have the option of continuing to
retain us as co-counsel on any matter that we have
referred to another attorney or firm.
